As in all breach cases, the prior standard has been that consumers needed to prove they were materially impacted by the data release. Doing that has been historically very hard and only doable after you end up with your identity stolen and living in a cardboard box, long after the group impacted has long given up and moved on.
This is the same judge that scrutinized Adobe when 38 million of their customer accounts went public.
